GENERAL TERMS AND CONDITIONS OF SALE (GTCS)

 

1 - PURPOSE

These General Terms and Conditions of Sale (GTCS) apply to products purchased through the website of Roadstar Management SA (hereinafter “Roadstar”), and define the terms and conditions governing the sale of products between Roadstar and the Customer.

Roadstar may amend or modify these GTCS at any time. The latest valid version of the GTCS is available on our website www.roadstar.ch (hereinafter “the Website”); only the version in force at the time of purchase shall apply.

 

2 - ORDERS

2.1 General Provisions

The Customer places an order in accordance with the instructions provided on the Website.

The sales contract for the product is concluded at the time of online payment, which also constitutes acceptance of these GTCS.

Any order confirmed by the Customer will be considered effective by Roadstar only after acceptance by the Shopify Payments server. The total amount of the order must be paid in full for the order to be considered final.

Through the Website, the Customer may request home delivery or, alternatively, collect the goods at Roadstar’s headquarters in Novazzano, Switzerland, subject to online payment and by appointment via email at shop@roadstar.com.

 

2.2 Anti-Fraud Verification

To ensure transaction security and prevent payment-related fraud, Roadstar reserves the right to verify the accuracy of the information provided by the Customer at the time of placing the order.

Consequently, Roadstar’s Customer Service may request one or more supporting documents from the Customer, by phone and/or email (e.g., a copy of an identity document and proof of residence).

Upon such request, the order will be placed on hold until the required documents are sent via email to shop@roadstar.com.

Furthermore, Roadstar reserves the right to cancel the order in case of non-compliance of the submitted documents or failure to provide them. In such cases, the cancellation does not entitle the Customer to any compensation.

 

3 - PRICING

Product prices on the Website are indicated in Swiss francs (CHF) and include VAT and other legal taxes, but exclude delivery costs. Delivery costs are charged to the Customer, in accordance with Article 6 of these GTCS.

The applicable product prices are those in effect at the time the Customer places the order.

 

4 - PAYMENT

Payment for the products and services available on the Website is due at the time the order is placed.

 

4.1 Payment Methods

Accepted payment methods are listed on www.roadstar.com. Payments are processed through the secure Shopify Payments system using:

  • CREDIT CARD (Visa, Mastercard, American Express, Union Pay)
  • SHOP PAY
  • WALLET (Apple Pay, Google Pay)
  • TWINT

 

For security reasons, the following documents must be presented when collecting products in person:

  • The order confirmation email, also accessible from the customer’s account on www.roadstar.com
  • The credit card used for the online purchase
  • A valid identity document

 

4.2 Non-Payment

Roadstar reserves the right to refuse to process an order or ship products to a Customer who has not fully or partially paid for a previous order or with whom a payment dispute is ongoing.

Roadstar also reserves the right to suspend or cancel any order and/or shipment, regardless of its stage of execution:

  • in the event of non-payment of any amounts due by the Customer, or
  • in the event of unsuccessful or invalid transactions.

 

5 - PROMOTIONAL POLICY

5.1 Promotional Offers

Roadstar may offer various promotions throughout the year.

 

5.2 Combination of Codes

Promotional offers requiring a promo code cannot be combined. Only one promotional code may be used per shopping cart and per order.

 

6 - PRODUCT AVAILABILITY AND SHIPPING

6.1 Conditions

Deliveries are available only within Switzerland and Liechtenstein. Shipping costs are at the Customer’s expense, vary depending on the type of order, and are indicated to the Customer at the time of payment.

 

6.2 Free Shipping

Free shipping offers are applied via promotional codes and cannot be combined with other ongoing promotions. Only one delivery method can be selected per order.

 

6.3 Availability

Product availability is displayed when the Customer checks stock on the Website. The Customer can track the status of their order at any time via www.post.ch by entering the tracking number.

 

6.4 Delays

Product shipments are handled by Swiss Post Priority, which guarantees delivery within 2–3 business days. In the event of delivery delays, the Customer may contact Roadstar by email at shop@roadstar.com for a prompt resolution.

 

6.5 Delivery or In-Store Pickup

For products collected directly by the Customer, the transfer of risk occurs at the time the goods are handed over to the Customer. For shipped products, the transfer of risk occurs upon delivery at the Customer’s address.

Products selected for in-store pickup must be collected within 15 days. After the 10th day, Roadstar will send a pickup reminder to the Customer. If the goods are not collected within 5 days following this reminder, Roadstar reserves the right to terminate the contract and retain the entire amount paid by the Customer as compensation for damages.

For security reasons, the following documentation will systematically be required when collecting products in person:

  • The order confirmation email, also accessible through the Customer’s account on www.roadstar.com
  • The credit card used for the online purchase
  • A valid identity document

At the time of collection, the Customer will also be required to sign the “pickup confirmation” form provided by Roadstar.

 

7 - PRODUCT RETURNS – RIGHT OF WITHDRAWAL

7.1 Inquiries and Defect Reports

For any inquiries or to report product defects, Customers may contact Roadstar Customer Service at shop@roadstar.com.

The Customer must ensure, at the time of order availability or upon delivery, that the number of packages received matches what was declared and that the products are in good condition.

If the delivered product does not match the nature or quantity of the order, or if it has been damaged during transport, the Customer must contact Roadstar by email at shop@roadstar.com within 3 business days from receipt, attaching the completed “return form” available on the Roadstar Website.

It is essential that the Customer keeps the products in their original packaging and in the same condition in which they were delivered.

 

7.2 Right of Withdrawal

For sales within Switzerland and Liechtenstein, no right of withdrawal is granted.

 

8 - PRODUCT SETUP

The Customer is solely responsible for the installation and/or activation of products they have collected in person or received by delivery.

 

9 - WARRANTY AND AFTER-SALES SERVICE

9.1 Warranty Definition

Unless otherwise specified, products sold online by Roadstar are covered by a two-year legal warranty for defects, in accordance with the Swiss Code of Obligations. This warranty is effective from the date of purchase or in-store pickup of the product.

The warranty period is reduced to one year for second-hand or refurbished products.

A product is covered by the warranty only if accompanied by the original purchase receipt. The warranty applies exclusively to products in their original configuration at the time of purchase and only if the serial number remains legible.

In the event of a defect attributable to Roadstar, Roadstar reserves the right to:

1.      Replace the defective product, or

2.      Repair the product, or

3.      Cancel the sales contract and refund the purchase price.

The Customer cannot claim the right to terminate the sales contract, request a price reduction, or demand compensation for damages.

Product replacement or repair does not extend the warranty period. Any replaced parts or replacement products are also covered only for the remaining duration of the original warranty period.

The warranty coverage and related conditions are governed by these General Terms and Conditions of Sale (GTCS).

However, the Customer is responsible for verifying that the product is intact and in good condition upon receipt. Any rights under warranty are lost if defects, either evident or potentially detectable at the time of delivery, are not reported immediately upon discovery. The same applies if the Customer fails to follow the assembly instructions or mishandles the product.

The following points are also specifically highlighted:

 

Warranty Exclusions

Roadstar’s liability is limited to cases of intentional misconduct or gross negligence. Roadstar assumes no responsibility for errors or omissions on the Website or in Roadstar’s product catalogs.

 

Accessories and Wear-and-Tear Parts

Accessories such as remote controls, batteries, etc., as well as wear-and-tear items like light bulbs and disposable batteries, are not covered by the warranty and do not entitle the Customer to a refund or exchange.

 

Product Use

The Customer loses all warranty rights if the product is used outside the scope of private and domestic use, for which the product was originally sold.

 

Warranty Exclusions Related to the Origin of Damage

Roadstar provides no warranty coverage for accidental material damage. In particular, the warranty does not cover defects, deterioration, or malfunctions resulting from incorrect installation, improper use, or inadequate maintenance of the product, including but not limited to:

  • Improper use of the product or failure to comply with the user instructions
  • Use of energy sources other than those specified by the manufacturer
  • Addition of components not authorized by the manufacturer
  • Opening, modifying, or tampering with the product’s internal components
  • Lightning, floods, fire, power surges, impacts, poor ventilation, falls, discoloration from sunlight, burns, humidity, overheating without a humidifier, uneven surfaces, or insect infestation
  • Repairs and/or any intervention on the product by unauthorized personnel
  • Maintenance, repair, or replacement of components due to normal wear and tear or lack of proper upkeep
  • External damage to the product
  • Damage caused by third parties or resulting from intentional acts
  • Computer viruses
  • Improper or incorrect software installation
  • Use of non-original or incompatible peripherals, software, or components
  • Alteration of the product’s original construction or technical specifications
  • Use of the product for professional, commercial, or public environments
  • Corrosion, oxidation, improper connections, or external power supply issues. For example, the warranty does not apply in the case of connecting the product to a defective power outlet.

 

Warranty Exclusions Related to the Nature of the Damage (Indirect Damages)

Roadstar provides no warranty coverage for indirect damages resulting from product malfunction or deterioration, including but not limited to:

  • Costs related to installation, setup, adjustment, or cleaning;
  • Any damages or losses of any kind arising from the unavailability of the product under warranty during the period between its malfunction or deterioration and its repair, replacement, or refund.

 

Additional Exclusions

  • Damages and malfunctions covered under the manufacturer’s warranty exclusions specified in the product’s user manual;
  • Aesthetic damages;
  • Damages and malfunctions affecting accessories (e.g., antennas, external cables, remote controls, earphones, batteries, etc.);
  • Adjustments that can be carried out by the Customer without dismantling the product, as well as adjustments the Customer could have easily made by following the provided instructions;
  • Products under warranty that the Customer is unable to return or products returned without their original accessories;
  • Products under warranty whose model or serial numbers are unreadable or have been altered by the Customer.

 

10 - LIABILITY

Roadstar shall not be held liable for any indirect damages, incidental costs, or losses, including but not limited to loss of data or information, as well as any damages or expenses arising from the use or inability to use the product by the Customer.

 

11 - FORCE MAJEURE

Roadstar shall not be held responsible for failing to perform its contractual obligations in cases of force majeure.

For the purposes of these GTCS, force majeure refers to any event or circumstance that is unavoidable, unforeseeable, and beyond the control of the parties involved.

 

12 - PROCESSING OF PERSONAL DATA

Roadstar collects and processes the Customer’s personal data in connection with its business activities and the execution of the sales contract, particularly with regard to managing purchases and responding to Customer inquiries.

Details regarding data processing, together with related information, are provided in the Privacy Policy, available on www.roadstar.com.

By purchasing a product, creating a Customer account, visiting a Roadstar store, browsing the Website, or otherwise interacting with Roadstar, the Customer accepts the terms and principles outlined in the Privacy Policy.

The Customer is expressly informed that Roadstar may send marketing and promotional communications by post, email, and SMS regarding Roadstar products, unless the Customer expressly opts out. These communications may also include offers from Roadstar’s business partners.

In the context of services provided within the Customer–Roadstar relationship, some services may be handled by third-party partners. In such cases, the Customer will be informed directly. When data is processed by a third-party partner, the processing of personal data is the sole responsibility of that partner, and the relationship exists exclusively between the third-party provider and the Customer.

Personal data collected may be transferred to and processed in countries outside Switzerland, including Canada and the United States, where data protection laws may differ from Swiss legislation.

13 - APPLICABLE LAW – DISPUTE MEDIATION

These General Terms and Conditions of Sale (GTCS) are governed exclusively by Swiss law, excluding the Swiss rules of private international law and any international treaties signed or ratified by Switzerland.

The exclusive place of jurisdiction is Mendrisio, Switzerland.
